Across New South Wales, many parents and individuals have been harmed by systemic failures in policing practices.

This includes the misuse of Apprehended Violence Orders (AVOs), the initiation or maintenance of criminal or quasi-criminal proceedings without proper investigation, and police actions that have had devastating consequences for families β€” particularly where those actions intersect with Family Court or other civil proceedings.

For too long, these experiences have been treated as isolated incidents.

They are not.

What This Is About

A proceeding is currently before the District Court of New South Wales against the State of New South Wales (NSW Police Force).

This action concerns patterns of conduct, including but not limited to:

  • AVOs or charges issued based on historic, disputed, or untested allegations

  • Police acting on one party’s claims while refusing to investigate counter-allegations

  • Proceedings later withdrawn, dismissed, or abandoned due to lack of evidence

  • Police actions that were relied upon to influence Family Court outcomes

  • Loss of contact with children, reputational damage, psychological injury, and financial harm arising from these processes

  • Prolonged procedural delays that compound harm and prevent resolution

These practices have left many people cut off from their children, their livelihoods, and their sense of justice, often without meaningful recourse.

At Kilo 4 Delta, we are taking a stand.

Who Should Register an Expression of Interest

You are encouraged to register if you are based in NSW and believe you have been affected by police conduct, including if you:

  • Were subject to an AVO or charges that lacked reasonable and probable cause

  • Believe police proceedings were used to gain leverage in Family Court or other proceedings

  • Made complaints to NSW Police as a victim and were dismissed, ignored, or not investigated

  • Had matters withdrawn or dismissed after significant harm had already occurred

  • Continue to suffer emotional, psychological, reputational, familial, or financial harm

You do not need to have identical circumstances to others.

Class actions are based on shared legal issues and systemic patterns, not identical facts.

Why We Are Collecting This Information

Because one person speaking out is brave. But many people speaking out together can drive real change.

Expressions of Interest are being collected to:

  • Assess eligibility and scope for a District Court class action

  • Identify recurring issues and systemic failures within NSW Police practices

  • Support ongoing court proceedings

  • Inform potential submissions to ministers and judicial stakeholders regarding reform
